NPPA Revises Ceiling Price of 233 Scheduled Formulation, Details

New Delhi: In accordance with the price revision as per the annual wholesale price index (WPI) increase of 12.1218%, through a recent notification, the National Pharmaceutical Pricing Authority (NPPA), the Ministry of Chemicals and Fertilisers, the Government of India has revised and fixed the ceiling price of 233 scheduled formulations under the Drug (Price Control) Order, 2013.

The list includes 5-aminosalicylic Acid, 5-Fluorouracil, Acetylsalicylic acid, All-trans Retinoic Acid, Amphotericin B (Lipid), Amphotericin B (Liposomal), Ampicillin, Anti-D immunoglobulin, Anti-rabies immunoglobulin, Anti-tetanus immunoglobulin, Arsenic Trioxide, Azithromycin, BCG vaccine, Benzathine benzylpenicillin, Benzoyl Peroxide, Betamethasone, Budesonide, Calcium Carbonate, Calcium gluconate, Cefadroxil and others.

Earlier, the Medical Dialogue Team had reported that according to the NPPA notification, based on the Wholesale Price Index (WPI) data provided by the Office of the Economic Advisor, Department of Industry and Internal Trade, Ministry of Commerce and Industry, the annual change in the WPI works out to 12.1218% during the calendar year 2022 over the corresponding period in 2021.

In relation to the above, the pharma industry is going to see the highest ever annual increase in prices of essential medicines as the cost of such drugs including painkillers, anti-infectives, antibiotics are set to rise by more than 12 percent effective April 1, 2023.

Scheduled formulation means any formulation, included in the First Schedule whether referred to by generic versions or brand name (mainly products covered under the National List of Essential Medicines are Scheduled Formulation). In other words, all medicines that are covered in National List of Essential Medicine, which are notified in Schedule 1, by the Govt. are scheduled formulation.

“Ceiling Price” refers to a price fixed by the Government for Scheduled Formulations in accordance with the provisions of drugs (prices control) order, 2013. Ceiling Price is the Maximum Price to Retailer (excluding Taxes, if any) for the given product.

The notice declared that in exercise of the powers, conferred by paragraphs 4, 6, 10, 11, 14, 16, 17 and 18 of the Drugs (Prices Control) Order, 2013, read with S.O. No. 1394(E) dated the 30th May 2013, 5249(E) dated 11th November 2022 issued by the Government of India in the Ministry of Chemicals and Fertilizers, and in supersession of the Order(s) of the Government of India in the Ministry of Chemicals and Fertilizers (National Pharmaceutical Pricing Authority) S.O. Number and date specified in column no. 6(a) & 6(b) mentioned in the table below, the National Pharmaceutical Pricing Authority, has fixed the prices as specified in column (5) of the table herein below as ceiling prices exclusive of Goods and Services Tax applicable, if any in respect of the Scheduled formulations specified in the corresponding entry in a column of the said Table with the dosage form & strength and unit specified respectively in the corresponding entries in columns (3) and (4) thereof:

Notes: –
a) The ceiling prices are applicable with effect from 01.04.2023 (ceiling prices are inclusive of Wholesale Price Index (WPI) @12.1218% for the year 2022 over 2021).
b) In respect of formulation where pack wise ceiling price is notified, for any other pack size manufactured, the manufacturer shall approach NPPA under para 11(3) of DPCO, 2013 for specific price approval for its formulations.
c) In respect of any other scheduled formulation, for which ceiling price is not mentioned above, the manufacturer shall approach NPPA for specific price approval for its formulations.
d) All manufacturers of scheduled formulations, selling branded or generic or both the versions of scheduled formulations at price higher than the ceiling price (plus Goods and Services Taxes as applicable) so fixed and notified by the Government, shall revise the prices of all such formulations downward not exceeding the ceiling price specified in column (5) in the above table plus Goods and Services Taxes as applicable, if any.
e) All the existing manufacturers of above mentioned scheduled formulations having MRP lower than the ceiling price notified vide S.O. No. and Date as specified in column 6 (a)& 6 (b) in the above table (plus Goods and Services Taxes as applicable, if any), may revise the existing MRP of their formulations, on the basis of WPI @ 12.1218% for the year 2022over 2021in accordance with paragraph 16(2) of DPCO, 2013.
f) The manufacturers may add Goods and Services Taxes only if they have paid actually or if it is payable to the Government on the ceiling price mentioned in column (5) of the above-said table.
g) Information about the revision, if carried out, shall be forwarded to the Government in either electronic or physical form in Form-II within a period of fifteen days of such revision and non-submission of the information under this subparagraph shall be construed as non-revision of maximum retail price (MRP) and the concerned manufacturer shall be liable to deposit the amount charged over and above the pre-revised maximum retail price (MRP), alongwith interest thereon from the date of overcharging.
h) The ceiling price for a pack of the scheduled formulation shall be arrived at by the concerned manufacturer in accordance with the ceiling price specified in column (5) of the above table as per provisions contained in paragraph 11 of the Drugs (Prices Control) Order, 2013. The manufacturer shall issue a price list in Form–V from the date of Notification as per paragraph 24 of the DPCO, 2013 to NPPA through IPDMS and submit a copy to State Drug Controller and dealers.
i) As per para 24(4) of DPCO 2013, every retailer and dealer shall display the price list and the supplementary price list, if any, as furnished by the manufacturer, on a conspicuous part of the premises where he carries on business in a manner to be easily accessible to any person wishing to consult the same.
j) Where an existing manufacturer of scheduled formulation with dosage or strength or both as specified in the above table launches a new drug as per paragraph 2 (1) (u) of the DPCO, 2013 such existing manufacturer shall apply for prior price approval of a such new drug to NPPA in Form I as specified under Schedule-II of the DPCO, 2013.
k) The manufacturers of above said scheduled formulations shall furnish quarterly returns to NPPA, in respect of production/import and sale of scheduled formulations in Form-III of Schedule-II of the DPCO, 2013 through IPDMS. Any manufacturer intending to discontinue production of above said scheduled formulation shall furnish information to NPPA, in respect of discontinuation of production and/or import of scheduled formulation in Form-IV of Schedule-II of the DPCO, 2013 at least six months prior to the intended date of discontinuation.
l) The manufacturers not complying with the ceiling price and notes specified hereinabove shall be liable to deposit the overcharged amount along with interest thereon under the provisions of the Drugs (Prices Control) Order, 2013 read with Essential Commodities Act, 1955.
m) Consequent to the issue of ceiling prices of such formulations as specified in column (2) of the above table in this notification, the price order(s) fixing ceiling or retail price, if any, issued prior to the above-said date of notification, stand(s) superseded.
